Introduction
THIS AGREEMENT CONTAINS A MANDATORY ARBITRATION CLAUSE AND A CLASS ACTION WAIVER THAT WAIVES YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION. YOU MUST REVIEW THIS DOCUMENT IN ITS ENTIRETY, INCLUDING THE DISPUTE RESOLUTION SECTION BELOW, BEFORE USING THE PLATFORM.
These Terms of Service (“Terms,” “Agreement”) govern your access to and use of the digital growth solutions, platforms, applications, software, and services (collectively, the “Platform” or “Services”) offered by Web Growth Hub LLC (“Web Growth Hub,” “Company,” “we,” “our,” or “us”). Please read these Terms carefully.
By creating an account, registering, subscribing, or otherwise using the Platform, you acknowledge and agree that:
You have read, understood, and consented to be bound by these Terms;
You are of legal age and capacity to form a binding contract in your jurisdiction;
You have the authority to enter into these Terms personally or on behalf of the business entity you represent;
The information you provide during registration and throughout your subscription is accurate, complete, and current; and
You will comply with all applicable laws, regulations, and industry obligations in your use of the Services.
If you do not agree to these Terms, you may not access or use the Platform. Once accepted, these Terms constitute a binding agreement between you and Web Growth Hub LLC and supersede all prior representations, understandings, or agreements relating to the Services, except where supplemented by additional contracts or addendums signed by Web Growth Hub. Web Growth Hub reserves the right to update or amend these Terms at any time. Changes are effective immediately upon posting to our website or providing notice to you by other reasonable means. Your continued use of the Platform after such updates constitutes your acceptance of the revised Terms.

All disputes shall be governed under the laws of Connecticut, with binding arbitration seated in Connecticut.
2. Use of Platform
2.1 Restrictions
You must be at least eighteen (18) years of age to create an account and use the Services. By registering, you represent and warrant that you meet this age requirement. If you are registering on behalf of a business entity, you confirm that you have the authority to bind such entity to these Terms.
You may not use the Platform:
If you are a direct competitor of Web Growth Hub or seeking access to replicate, reverse-engineer, or compete with the Services;
For unlawful purposes, including fraud, harassment, or transmission of harmful content;
To violate any federal, state, or local law, including but not limited to laws governing telemarketing, spam, or data protection;
In any manner that disrupts or degrades the performance, security, or integrity of the Platform; For resale, sublicensing, or redistribution without prior written authorization from Web Growth Hub.
2.2 Account Ownership
The individual or entity that registers for the Platform shall be deemed the “Account Owner.” If the account was registered on behalf of a business entity, such entity shall be the Account Owner.
In the event of disputes regarding ownership, Web Growth Hub reserves the right to require official documentation, such as government filings or corporate resolutions, to determine rightful ownership. If ownership cannot be determined, Web Growth Hub may suspend or terminate the account until resolution is achieved through mutual agreement or a court order.
2.3 Intended Use
The Platform is designed for legitimate business use only. By using the Services, you agree:
To use the Platform only in accordance with applicable laws, regulations, and ethical business practices;
To maintain in effect all licenses, consents, and authorizations necessary to operate your business;
To accept full responsibility for the actions of your employees, agents, and customers using the Platform under your account;
To provide terms of service and privacy policies to your own customers at least as restrictive as those contained herein.
2.4 Compliance Obligations
You acknowledge and agree that:
You are solely responsible for compliance with all laws governing communications, data collection, storage, and processing, including but not limited to:
The Telephone Consumer Protection Act (TCPA);
CAN-SPAM Act;
HIPAA (Health Insurance Portability and Accountability Act), where applicable;
Gramm-Leach-Bliley Act;
State-level data privacy laws (e.g., California Consumer Privacy Act, “CCPA”);
European Union General Data Protection Regulation (“GDPR”), if applicable.
Web Growth Hub provides no guarantee that your use of the Platform is compliant with these laws. You are required to obtain your own legal counsel to ensure compliance.
You will provide prompt and reasonable cooperation with lawful requests from regulators, law enforcement, or telecommunications providers related to your use of the Services.
2.5 Login Credentials
You are solely responsible for safeguarding your login credentials. You may not share, transfer, or resell your access. You agree to immediately notify Web Growth Hub of any unauthorized access, suspected compromise, or security breach involving your account.
Web Growth Hub reserves the right to suspend or terminate access if it believes your credentials have been compromised or used in violation of these Terms.
2.6 Communications Services
The Platform may provide features for SMS, MMS, email, and voice communications. By using these services, you acknowledge:
You control the content, timing, and recipients of communications;
Web Growth Hub does not originate, send, or deliver communications;
You are solely responsible for compliance with applicable telecommunication laws, including the TCPA, CAN-SPAM, and Do Not Call rules;
You will indemnify Web Growth Hub against claims or fines arising from non-compliant communications.
2.7 Third-Party Integrations
The Platform may integrate with third-party applications and services. You acknowledge and agree that:
You are responsible for enabling, managing, and securing integrations;
Web Growth Hub disclaims liability for third-party applications, including outages, data loss, or costs incurred;
Use of third-party applications is subject to their own terms of service, which you must review and accept independently.
2.8 International Use
If you access or use the Platform outside the United States, you do so at your own risk and are responsible for compliance with local laws.
You may not use the Platform in countries or territories subject to U.S. trade embargoes or restrictions, or if you are listed on any U.S. government denied-party list.
2.9 Free Trials and Excessive Use
Web Growth Hub may offer a fourteen (14) day free trial to new customers. Free trials are strictly limited to one per customer or business entity. Attempts to circumvent this restriction by creating multiple accounts, using different emails, or other deceptive practices will result in termination and prohibition from further use of the Platform.
Excessive use of resources during trial or paid subscriptions that, in Web Growth Hub’s sole discretion, impairs the Platform’s performance for others may result in suspension, throttling, or requirement to upgrade to a higher-tier plan.
2.10 AI Features Disclaimer
Certain features of the Platform may use artificial intelligence (“AI”). By enabling or using such features, you acknowledge and agree:
AI may produce inaccurate, incomplete, or biased results;
AI features are provided “as is,” with no guarantee of accuracy or reliability;
You assume full responsibility for reviewing, verifying, and using AI outputs;
Web Growth Hub disclaims liability for errors, omissions, or damages resulting from reliance on AI-generated outputs.
3. Payments, Fees, and Refund Policy
3.1 Pricing and Subscription Plans
Web Growth Hub offers subscription packages starting at $97, $197, and $497 per month, with additional add-on features available, including but not limited to:
Additional user accounts;
AI voice assistants;
Listings deployment;
Dedicated account management services;
Expanded storage and hosting resources.
Your use of the Platform requires timely payment of all subscription fees and charges associated with your chosen plan.
3.2 Billing and Invoicing
All subscriptions are billed in advance on a recurring monthly basis unless you select an annual or other extended commitment plan offered by Web Growth Hub. By subscribing, you authorize Web Growth Hub to automatically charge the payment method on file for all applicable fees, taxes, and add-ons.
If your payment method fails, Web Growth Hub may reattempt charges for up to seven (7) business days. After that, your account may be suspended or terminated for non-payment.
3.3 Free Trial and Transition to Paid Plan
Web Growth Hub may provide a 14-day free trial to new customers. Upon expiration of the trial, your account will automatically convert to a paid subscription unless you cancel prior to the end of the trial period. You authorize Web Growth Hub to charge your payment method on file at the start of the paid subscription.
3.4 Refund Policy
All fees and charges are strictly non-refundable. This includes, but is not limited to:
Monthly or annual subscription fees;
Add-on services;
Communication surcharges (e.g., SMS, call minutes, email credits);
Partial month usage;
Setup fees, onboarding fees, or account configuration services.
No refunds will be issued for cancellation, non-use, or dissatisfaction with the Services. All transactions are final.
3.5 Taxes
All fees are exclusive of applicable sales, VAT, GST, and use taxes. You are solely responsible for remitting any required taxes associated with your subscription. Web Growth Hub may collect and remit taxes as required by applicable law, but final responsibility rests with you.
3.6 Cancellation Policy
You may cancel your subscription at any time by:
Managing billing through the “Manage Billing” section of your account dashboard, or
Contacting Web Growth Hub directly by email at [email protected] or by phone through our support number.
Cancellations will take effect at the end of your current billing cycle. You remain responsible for all fees incurred through the date of cancellation.
3.7 Restrictions on Free Trials
Customers may not attempt to obtain multiple free trials by creating duplicate accounts, using different payment methods, or employing other deceptive practices. Web Growth Hub reserves the right to suspend or terminate any account it reasonably believes has violated this restriction.
4. Intellectual Property
4.1 Web Growth Hub Ownership
The Platform, including but not limited to its software, source code, architecture, content, logos, graphics, trade dress, and proprietary algorithms, are the sole and exclusive property of Web Growth Hub LLC. All rights not expressly granted to you in these Terms are reserved by Web Growth Hub.
You acknowledge that:
You do not acquire any ownership rights by using the Platform;
You may not copy, reproduce, reverse engineer, or attempt to discover the underlying source code or structure of the Platform;
You may not resell, sublicense, or redistribute any portion of the Platform without express written consent.
4.2 Customer Data Ownership
You retain ownership of all data and content you provide to the Platform. However, you grant Web Growth Hub a limited, non-exclusive, royalty-free, worldwide license to store, process, transmit, and display such data solely for the purpose of providing Services.
4.3 Data Export Rights
Customers may export their data at any time while their subscription remains active. Upon cancellation or termination of a subscription, Web Growth Hub is under no obligation to provide continued access to data. Customers are solely responsible for exporting and safeguarding their data prior to termination.
Failure to export data before subscription termination does not obligate Web Growth Hub to provide post-termination access. Customers acknowledge that failure to plan for cancellation is not grounds for exception to this policy.
4.4 Customer Content Responsibilities
You represent and warrant that you own or control the rights to all content uploaded to the Platform and that such content does not infringe any third-party rights, including copyright, trademark, or privacy rights.
4.5 Feedback
Any feedback, suggestions, or recommendations you provide to Web Growth Hub may be freely used by the Company for product development, marketing, or improvement without obligation to you. You hereby grant Web Growth Hub a perpetual, irrevocable, royalty-free license to use, modify, and incorporate such feedback into the Platform.
5. Customer Responsibilities
5.1 Accuracy of Information
You agree to provide accurate and current information to Web Growth Hub at all times, including during registration, subscription, and billing. Inaccurate or fraudulent information may result in suspension or termination of your account.
5.2 Compliance with Laws
You assume full responsibility for ensuring that your use of the Platform complies with all applicable federal, state, and local laws. This includes, but is not limited to, compliance with:
TCPA (Telephone Consumer Protection Act);
CAN-SPAM Act governing email communications;
HIPAA regarding health information, if applicable;
GDPR and CCPA regarding data privacy;
FTC regulations on advertising and consumer protection.
Web Growth Hub disclaims all liability for non-compliance with these laws.
5.3 Customer-Facing Policies
You are responsible for implementing and enforcing your own Terms of Service and Privacy Policy for your end-customers. Such policies must provide protections at least as stringent as those contained in these Terms.
5.4 Customer Relations
Web Growth Hub is not responsible for disputes, claims, or damages arising from your relationship with your customers. You acknowledge that you are solely responsible for handling customer complaints, chargebacks, refunds, or disputes related to your business operations.
5.5 Security and Access
You must implement safeguards to protect your login credentials and prevent unauthorized use of your account. You are responsible for all actions taken under your account, whether authorized or unauthorized.
6. AI and Automation Services
6.1 Nature of AI Services
The Platform may include features powered by artificial intelligence, machine learning, or automation technologies (“AI Services”). These may include, but are not limited to:
Voice AI assistants and call handling agents;
Automated chatbots and messaging flows;
Automated review generation, scheduling, or posting;
Predictive analytics and campaign optimization tools.
6.2 Limitations of AI Services
You acknowledge and agree that AI Services:
Are experimental and may generate inaccurate, incomplete, or misleading results;
May rely on training data or third-party sources beyond Web Growth Hub’s control;
Are not substitutes for professional human judgment;
May not comply with specific industry regulations unless expressly configured to do so by you.
6.3 Assumption of Risk
By using AI Services, you accept full responsibility for evaluating the accuracy, reliability, and appropriateness of outputs. You assume all risk associated with reliance on AI Services in making business, operational, or financial decisions.
6.4 No Guarantee of Outcomes
Web Growth Hub does not guarantee that AI Services will:
Increase leads, conversions, sales, or revenue;
Produce accurate or unbiased communications;
Ensure compliance with laws or regulations;
Reduce labor or operational costs.
7. Disclaimers of Warranty
7.1 “As-Is” Provision
The Platform and Services are provided “AS IS” and “AS AVAILABLE.” Web Growth Hub expressly disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to:
Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
Warranties that the Services will be uninterrupted, error-free, secure, or free of viruses;
Warranties regarding the reliability, timeliness, or accuracy of outputs from the Platform, including AI Services.
7.2 Third-Party Services
Web Growth Hub disclaims all responsibility for third-party services, providers, or integrations accessible through the Platform. Your use of such services is at your own risk and governed by separate agreements between you and those providers.
7.3 No Professional Advice
The Platform does not provide legal, financial, medical, or professional advice. You agree that any information provided by Web Growth Hub is for general informational purposes only and should not be relied upon as a substitute for independent professional judgment.
8. Limitation of Liability
8.1 Liability Cap
To the maximum extent permitted by law, Web Growth Hub’s liability for any claim, damage, or loss arising out of or relating to these Terms or the Platform shall not exceed the amount paid by you to Web Growth Hub during the three (3) months preceding the event giving rise to the claim.
8.2 Exclusion of Damages
In no event shall Web Growth Hub be liable for:
Indirect, incidental, punitive, or consequential damages;
Lost profits, lost business opportunities, or loss of goodwill;
Data loss, corruption, or unauthorized access resulting from your actions or omissions;
Interruptions caused by telecommunications failures, internet outages, or acts beyond Web Growth Hub’s control.
8.3 Allocation of Risk
You acknowledge that the limitations and exclusions of liability in this Agreement are fundamental to the allocation of risk between the parties, and that the fees charged would be higher without such limitations.
9. Indemnification
You agree to indemnify, defend, and hold harmless Web Growth Hub, its affiliates, officers, employees, contractors, and agents from and against all claims, damages, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or related to:
Your access to or use of the Platform;
Content or data you transmit through the Platform;
Your violation of any applicable law, regulation, or third-party right;
Disputes between you and your customers, vendors, or partners;
Communications initiated through the Platform that violate telemarketing, spam, or data protection laws;
Breach of these Terms or misuse of the Platform.
Web Growth Hub reserves the right to assume control of its defense in any matter subject to indemnification. You agree to provide cooperation and assistance at your own expense.
10. Termination and Suspension
10.1 Termination by Web Growth Hub
Web Growth Hub may suspend or terminate your account immediately, without prior notice, if it determines in its sole discretion that you have:
Failed to pay subscription fees or incurred outstanding balances;
Provided false, inaccurate, or misleading information;
Violated these Terms, applicable laws, or regulations;
Engaged in conduct harmful to Web Growth Hub, its users, or third parties;
Misused or attempted to reverse-engineer the Platform.
10.2 Termination by You
You may terminate your subscription at any time by following the cancellation procedures described in Section 3.6.
10.3 Effect of Termination
Upon termination for any reason:
Your right to use the Platform ceases immediately;
You remain responsible for any fees accrued through the termination date;
Web Growth Hub may delete or disable access to your data and account content;
Web Growth Hub has no obligation to store, maintain, or return your data post-termination.
10.4 Suspension for Cause
Web Growth Hub may suspend access to your account if your use of the Platform:
Threatens the integrity or security of the Platform;
Violates laws, regulations, or third-party rights;
Causes disruption to other users.
Suspension may continue until the violation is resolved to Web Growth Hub’s satisfaction.
11. Force Majeure
11.1 General Release
Web Growth Hub shall not be liable or responsible for any failure or delay in performance caused by events or circumstances beyond its reasonable control, including but not limited to:
Acts of God, natural disasters, floods, fires, earthquakes, or storms;
War, terrorism, riots, or acts of civil unrest;
Labor disputes, strikes, or shortages of labor or materials;
Failures of telecommunications, internet service providers, or third-party hosting services;
Government actions, embargoes, sanctions, or regulatory requirements;
Power outages, cyberattacks, denial-of-service attacks, or other malicious acts by third parties.
11.2 Continuation of Obligations
Where feasible, Web Growth Hub will make commercially reasonable efforts to mitigate the impact of a Force Majeure Event and to resume performance as soon as reasonably practicable.
11.3 No Breach
Any delay or failure in performance resulting from a Force Majeure Event shall not constitute a breach of these Terms.
12. Dispute Resolution and Governing Law
12.1 Governing Law
These Terms shall be governed exclusively by the laws of the State of Connecticut, without regard to conflict of law provisions.
12.2 Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms, the Platform, or the Services shall be resolved by binding arbitration in Connecticut under the rules of the American Arbitration Association (AAA).
Arbitration shall be conducted before a single arbitrator selected in accordance with AAA procedures.
The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of these Terms.
Judgment upon the arbitration award may be entered in any court of competent jurisdiction.
12.3 Waiver of Class Actions
You acknowledge and agree that any arbitration or proceeding shall be conducted only on an individual basis and not in a class, consolidated, or representative action. You expressly waive your right to participate in a class action or class-wide arbitration.
12.4 Limitation on Claims
Any claim you may have against Web Growth Hub must be filed within one (1) year of the event giving rise to the claim, or such claim shall be barred permanently.
13. Miscellaneous
13.1 Entire Agreement
These Terms, together with the Privacy Policy and any supplemental agreements or addendums, constitute the entire agreement between you and Web Growth Hub regarding your use of the Platform.
13.2 No Exclusivity
You acknowledge and agree that Web Growth Hub may provide Services to competitors, and nothing in these Terms grants you exclusivity.
13.3 Severability
If any provision of these Terms is found unenforceable or invalid, the remaining provisions shall remain in full force and effect.
13.4 Assignment
You may not assign or transfer your rights under these Terms without prior written consent from Web Growth Hub. Web Growth Hub may assign these Terms in connection with a merger, acquisition, or sale of assets without restriction.
13.5 Notices
Notices shall be deemed properly given when:
Sent by email to [email protected];
Posted publicly on Web Growth Hub’s website; or
Sent by certified mail to the business address listed in Section 1.
13.6 Waiver
Failure by Web Growth Hub to enforce any provision shall not constitute a waiver of its right to enforce that provision at a later time.
13.7 Headings
Headings are for convenience only and shall not affect interpretation.
Exhibit A – Code of Conduct
Users of the Platform agree to abide by the following Code of Conduct:
Professional Use: The Platform shall be used solely for legitimate business purposes.
Respect for Others: Users may not engage in harassment, threats, or abusive conduct through the Platform.
No Misrepresentation: Users may not impersonate others or misrepresent their business affiliations.
No Malicious Activity: Users shall not upload viruses, malware, or harmful code to the Platform.
Transparency in Communications: All communications sent through the Platform must be truthful and not deceptive or misleading.
Compliance with Laws: Users agree to comply with all federal, state, and international laws, including those governing advertising, data privacy, and telecommunication.
Accountability: Users are responsible for the actions of their employees, contractors, or agents who access the Platform under their account.
Violation of this Code may result in suspension or termination of access.
Exhibit B – AI Acceptable Use
While Web Growth Hub reserves the right to issue a more detailed AI policy in the future, the following rules apply at this time:
No Sensitive Reliance: AI Services may not be used to provide medical, legal, financial, or professional advice without human oversight.
No Misuse: AI Services may not be used to generate unlawful, harmful, or discriminatory outputs.
Review Required: Users must review and approve AI outputs prior to reliance or use in business operations.
Responsibility: Users remain solely responsible for all outcomes resulting from AI-generated communications or outputs.
Exhibit C – Communications Compliance
The following apply to all communications made through the Platform:
Consent: You must obtain prior express consent before sending SMS, email, or voice communications to recipients.
Opt-Out Mechanisms: All communications must provide a clear and functional opt-out mechanism.
Do Not Call: You must honor all state and federal Do Not Call registry requirements.
Message Content: Messages may not contain false, deceptive, or misleading claims.
Identification: All messages must clearly identify your business and include contact information.
Indemnification: You indemnify Web Growth Hub for any regulatory penalties, fines, or claims resulting from your non-compliance.
Definitions
For purposes of these Terms, the following definitions shall apply:
“Account” means the subscription profile created by you or on your behalf to access the Platform.
“Add-On Services” means optional features beyond standard subscription tiers, including Voice AI, listings deployment, or additional users.
“AI Services” means artificial intelligence-driven features of the Platform.
“Agreement” means these Terms of Service and any referenced policies.
“Applicable Law” means all federal, state, local, and international laws and regulations governing your use of the Services.
“Billing Cycle” means the recurring monthly or annual period in which subscription fees are charged.
“Cancellation” means the termination of your subscription by you in accordance with Section 3.6.
“Content” means any data, text, images, audio, or video uploaded by you or your users.
“Customer” means your clients, prospects, or leads interacting with communications or websites deployed through the Platform.
“Data” means all information entered, uploaded, or transmitted through the Platform.
“Fees” means subscription charges, add-on charges, and all applicable taxes.
“Force Majeure Event” means circumstances beyond Web Growth Hub’s reasonable control as defined in Section 11.
“Indemnified Parties” means Web Growth Hub and its affiliates, officers, employees, contractors, and agents.
“Intellectual Property” means all copyrights, patents, trademarks, trade secrets, and proprietary technology of Web Growth Hub.
“Liability Cap” means the limitation of liability outlined in Section 8.
“Manage Billing” means the online portal within the Platform where subscription management occurs.
“Platform” means the Web Growth Hub software, applications, and services as defined in Section 2.
“Services” means the full suite of CRM, automation, AI, hosting, and related tools provided by Web Growth Hub.
“Subscription” means the ongoing license to use the Services in exchange for recurring payment of Fees.
“User” means any person authorized by you to access the Platform under your account.
“You” or “Your” means the individual or entity entering into these Terms.

All disputes shall be governed under the laws of Connecticut, with binding arbitration seated in Connecticut.
2. Use of Platform
2.1 Restrictions
You must be at least eighteen (18) years of age to create an account and use the Services. By registering, you represent and warrant that you meet this age requirement. If you are registering on behalf of a business entity, you confirm that you have the authority to bind such entity to these Terms.
You may not use the Platform:
If you are a direct competitor of Web Growth Hub or seeking access to replicate, reverse-engineer, or compete with the Services;
For unlawful purposes, including fraud, harassment, or transmission of harmful content;
To violate any federal, state, or local law, including but not limited to laws governing telemarketing, spam, or data protection;
In any manner that disrupts or degrades the performance, security, or integrity of the Platform;
For resale, sublicensing, or redistribution without prior written authorization from Web Growth Hub.
2.2 Account Ownership
The individual or entity that registers for the Platform shall be deemed the “Account Owner.” If the account was registered on behalf of a business entity, such entity shall be the Account Owner.
In the event of disputes regarding ownership, Web Growth Hub reserves the right to require official documentation, such as government filings or corporate resolutions, to determine rightful ownership. If ownership cannot be determined, Web Growth Hub may suspend or terminate the account until resolution is achieved through mutual agreement or a court order.
2.3 Intended Use
The Platform is designed for legitimate business use only. By using the Services, you agree:
To use the Platform only in accordance with applicable laws, regulations, and ethical business practices;
To maintain in effect all licenses, consents, and authorizations necessary to operate your business;
To accept full responsibility for the actions of your employees, agents, and customers using the Platform under your account;
To provide terms of service and privacy policies to your own customers at least as restrictive as those contained herein.
2.4 Compliance Obligations
You acknowledge and agree that:
You are solely responsible for compliance with all laws governing communications, data collection, storage, and processing, including but not limited to:
The Telephone Consumer Protection Act (TCPA);
CAN-SPAM Act;
HIPAA (Health Insurance Portability and Accountability Act), where applicable;
Gramm-Leach-Bliley Act;
State-level data privacy laws (e.g., California Consumer Privacy Act, “CCPA”);
European Union General Data Protection Regulation (“GDPR”), if applicable.
Web Growth Hub provides no guarantee that your use of the Platform is compliant with these laws. You are required to obtain your own legal counsel to ensure compliance.
You will provide prompt and reasonable cooperation with lawful requests from regulators, law enforcement, or telecommunications providers related to your use of the Services.
2.5 Login Credentials
You are solely responsible for safeguarding your login credentials. You may not share, transfer, or resell your access. You agree to immediately notify Web Growth Hub of any unauthorized access, suspected compromise, or security breach involving your account.
Web Growth Hub reserves the right to suspend or terminate access if it believes your credentials have been compromised or used in violation of these Terms.
2.6 Communications Services
The Platform may provide features for SMS, MMS, email, and voice communications. By using these services, you acknowledge:
You control the content, timing, and recipients of communications;
Web Growth Hub does not originate, send, or deliver communications;
You are solely responsible for compliance with applicable telecommunication laws, including the TCPA, CAN-SPAM, and Do Not Call rules;
You will indemnify Web Growth Hub against claims or fines arising from non-compliant communications.
2.7 Third-Party Integrations
The Platform may integrate with third-party applications and services. You acknowledge and agree that:
You are responsible for enabling, managing, and securing integrations;
Web Growth Hub disclaims liability for third-party applications, including outages, data loss, or costs incurred;
Use of third-party applications is subject to their own terms of service, which you must review and accept independently.
2.8 International Use
If you access or use the Platform outside the United States, you do so at your own risk and are responsible for compliance with local laws.
You may not use the Platform in countries or territories subject to U.S. trade embargoes or restrictions, or if you are listed on any U.S. government denied-party list.
2.9 Free Trials and Excessive Use
Web Growth Hub may offer a fourteen (14) day free trial to new customers. Free trials are strictly limited to one per customer or business entity. Attempts to circumvent this restriction by creating multiple accounts, using different emails, or other deceptive practices will result in termination and prohibition from further use of the Platform.
Excessive use of resources during trial or paid subscriptions that, in Web Growth Hub’s sole discretion, impairs the Platform’s performance for others may result in suspension, throttling, or requirement to upgrade to a higher-tier plan.
2.10 AI Features Disclaimer
Certain features of the Platform may use artificial intelligence (“AI”). By enabling or using such features, you acknowledge and agree:
AI may produce inaccurate, incomplete, or biased results;
AI features are provided “as is,” with no guarantee of accuracy or reliability;
You assume full responsibility for reviewing, verifying, and using AI outputs;
Web Growth Hub disclaims liability for errors, omissions, or damages resulting from reliance on AI-generated outputs.
3. Payments, Fees, and Refund Policy
3.1 Pricing and Subscription Plans
Web Growth Hub offers subscription packages starting at $97, $197, and $497 per month, with additional add-on features available, including but not limited to:
Additional user accounts;
AI voice assistants;
Listings deployment;
Dedicated account management services;
Expanded storage and hosting resources.
Your use of the Platform requires timely payment of all subscription fees and charges associated with your chosen plan.
3.2 Billing and Invoicing
All subscriptions are billed in advance on a recurring monthly basis unless you select an annual or other extended commitment plan offered by Web Growth Hub. By subscribing, you authorize Web Growth Hub to automatically charge the payment method on file for all applicable fees, taxes, and add-ons.
If your payment method fails, Web Growth Hub may reattempt charges for up to seven (7) business days. After that, your account may be suspended or terminated for non-payment.
3.3 Free Trial and Transition to Paid Plan
Web Growth Hub may provide a 14-day free trial to new customers. Upon expiration of the trial, your account will automatically convert to a paid subscription unless you cancel prior to the end of the trial period. You authorize Web Growth Hub to charge your payment method on file at the start of the paid subscription.
3.4 Refund Policy
All fees and charges are strictly non-refundable. This includes, but is not limited to:
Monthly or annual subscription fees;
Add-on services;
Communication surcharges (e.g., SMS, call minutes, email credits);
Partial month usage;
Setup fees, onboarding fees, or account configuration services.
No refunds will be issued for cancellation, non-use, or dissatisfaction with the Services. All transactions are final.
3.5 Taxes
All fees are exclusive of applicable sales, VAT, GST, and use taxes. You are solely responsible for remitting any required taxes associated with your subscription. Web Growth Hub may collect and remit taxes as required by applicable law, but final responsibility rests with you.
3.6 Cancellation Policy
You may cancel your subscription at any time by:
Managing billing through the “Manage Billing” section of your account dashboard, or
Contacting Web Growth Hub directly by email at [email protected] or by phone through our support number.
Cancellations will take effect at the end of your current billing cycle. You remain responsible for all fees incurred through the date of cancellation.
3.7 Restrictions on Free Trials
Customers may not attempt to obtain multiple free trials by creating duplicate accounts, using different payment methods, or employing other deceptive practices. Web Growth Hub reserves the right to suspend or terminate any account it reasonably believes has violated this restriction.
4. Intellectual Property
4.1 Web Growth Hub Ownership
The Platform, including but not limited to its software, source code, architecture, content, logos, graphics, trade dress, and proprietary algorithms, are the sole and exclusive property of Web Growth Hub LLC. All rights not expressly granted to you in these Terms are reserved by Web Growth Hub.
You acknowledge that:
You do not acquire any ownership rights by using the Platform;
You may not copy, reproduce, reverse engineer, or attempt to discover the underlying source code or structure of the Platform;
You may not resell, sublicense, or redistribute any portion of the Platform without express written consent.
4.2 Customer Data Ownership
You retain ownership of all data and content you provide to the Platform. However, you grant Web Growth Hub a limited, non-exclusive, royalty-free, worldwide license to store, process, transmit, and display such data solely for the purpose of providing Services.
4.3 Data Export Rights
Customers may export their data at any time while their subscription remains active. Upon cancellation or termination of a subscription, Web Growth Hub is under no obligation to provide continued access to data. Customers are solely responsible for exporting and safeguarding their data prior to termination.
Failure to export data before subscription termination does not obligate Web Growth Hub to provide post-termination access. Customers acknowledge that failure to plan for cancellation is not grounds for exception to this policy.
4.4 Customer Content Responsibilities
You represent and warrant that you own or control the rights to all content uploaded to the Platform and that such content does not infringe any third-party rights, including copyright, trademark, or privacy rights.
4.5 Feedback
Any feedback, suggestions, or recommendations you provide to Web Growth Hub may be freely used by the Company for product development, marketing, or improvement without obligation to you. You hereby grant Web Growth Hub a perpetual, irrevocable, royalty-free license to use, modify, and incorporate such feedback into the Platform.
5. Customer Responsibilities
5.1 Accuracy of Information
You agree to provide accurate and current information to Web Growth Hub at all times, including during registration, subscription, and billing. Inaccurate or fraudulent information may result in suspension or termination of your account.
5.2 Compliance with Laws
You assume full responsibility for ensuring that your use of the Platform complies with all applicable federal, state, and local laws. This includes, but is not limited to, compliance with:
TCPA (Telephone Consumer Protection Act);
CAN-SPAM Act governing email communications;
HIPAA regarding health information, if applicable;
GDPR and CCPA regarding data privacy;
FTC regulations on advertising and consumer protection.
Web Growth Hub disclaims all liability for non-compliance with these laws.
5.3 Customer-Facing Policies
You are responsible for implementing and enforcing your own Terms of Service and Privacy Policy for your end-customers. Such policies must provide protections at least as stringent as those contained in these Terms.
5.4 Customer Relations
Web Growth Hub is not responsible for disputes, claims, or damages arising from your relationship with your customers. You acknowledge that you are solely responsible for handling customer complaints, chargebacks, refunds, or disputes related to your business operations.
5.5 Security and Access
You must implement safeguards to protect your login credentials and prevent unauthorized use of your account. You are responsible for all actions taken under your account, whether authorized or unauthorized.
6. AI and Automation Services
6.1 Nature of AI Services
The Platform may include features powered by artificial intelligence, machine learning, or automation technologies (“AI Services”). These may include, but are not limited to:
Voice AI assistants and call handling agents;
Automated chatbots and messaging flows;
Automated review generation, scheduling, or posting;
Predictive analytics and campaign optimization tools.
6.2 Limitations of AI Services
You acknowledge and agree that AI Services:
Are experimental and may generate inaccurate, incomplete, or misleading results;
May rely on training data or third-party sources beyond Web Growth Hub’s control;
Are not substitutes for professional human judgment;
May not comply with specific industry regulations unless expressly configured to do so by you.
6.3 Assumption of Risk
By using AI Services, you accept full responsibility for evaluating the accuracy, reliability, and appropriateness of outputs. You assume all risk associated with reliance on AI Services in making business, operational, or financial decisions.
6.4 No Guarantee of Outcomes
Web Growth Hub does not guarantee that AI Services will:
Increase leads, conversions, sales, or revenue;
Produce accurate or unbiased communications;
Ensure compliance with laws or regulations;
Reduce labor or operational costs.
7. Disclaimers of Warranty
7.1 “As-Is” Provision
The Platform and Services are provided “AS IS” and “AS AVAILABLE.” Web Growth Hub expressly disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to:
Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
Warranties that the Services will be uninterrupted, error-free, secure, or free of viruses;
Warranties regarding the reliability, timeliness, or accuracy of outputs from the Platform, including AI Services.
7.2 Third-Party Services
Web Growth Hub disclaims all responsibility for third-party services, providers, or integrations accessible through the Platform. Your use of such services is at your own risk and governed by separate agreements between you and those providers.
7.3 No Professional Advice
The Platform does not provide legal, financial, medical, or professional advice. You agree that any information provided by Web Growth Hub is for general informational purposes only and should not be relied upon as a substitute for independent professional judgment.
8. Limitation of Liability
8.1 Liability Cap
To the maximum extent permitted by law, Web Growth Hub’s liability for any claim, damage, or loss arising out of or relating to these Terms or the Platform shall not exceed the amount paid by you to Web Growth Hub during the three (3) months preceding the event giving rise to the claim.
8.2 Exclusion of Damages
In no event shall Web Growth Hub be liable for:
Indirect, incidental, punitive, or consequential damages;
Lost profits, lost business opportunities, or loss of goodwill;
Data loss, corruption, or unauthorized access resulting from your actions or omissions;
Interruptions caused by telecommunications failures, internet outages, or acts beyond Web Growth Hub’s control.
8.3 Allocation of Risk
You acknowledge that the limitations and exclusions of liability in this Agreement are fundamental to the allocation of risk between the parties, and that the fees charged would be higher without such limitations.
9. Indemnification
You agree to indemnify, defend, and hold harmless Web Growth Hub, its affiliates, officers, employees, contractors, and agents from and against all claims, damages, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or related to:
Your access to or use of the Platform;
Content or data you transmit through the Platform;
Your violation of any applicable law, regulation, or third-party right;
Disputes between you and your customers, vendors, or partners;
Communications initiated through the Platform that violate telemarketing, spam, or data protection laws;
Breach of these Terms or misuse of the Platform.
Web Growth Hub reserves the right to assume control of its defense in any matter subject to indemnification. You agree to provide cooperation and assistance at your own expense.
10. Termination and Suspension
10.1 Termination by Web Growth Hub
Web Growth Hub may suspend or terminate your account immediately, without prior notice, if it determines in its sole discretion that you have:
Failed to pay subscription fees or incurred outstanding balances;
Provided false, inaccurate, or misleading information;
Violated these Terms, applicable laws, or regulations;
Engaged in conduct harmful to Web Growth Hub, its users, or third parties;
Misused or attempted to reverse-engineer the Platform.
10.2 Termination by You
You may terminate your subscription at any time by following the cancellation procedures described in Section 3.6.
10.3 Effect of Termination
Upon termination for any reason:
Your right to use the Platform ceases immediately;
You remain responsible for any fees accrued through the termination date;
Web Growth Hub may delete or disable access to your data and account content;
Web Growth Hub has no obligation to store, maintain, or return your data post-termination.
10.4 Suspension for Cause
Web Growth Hub may suspend access to your account if your use of the Platform:
Threatens the integrity or security of the Platform;
Violates laws, regulations, or third-party rights;
Causes disruption to other users.
Suspension may continue until the violation is resolved to Web Growth Hub’s satisfaction.
11. Force Majeure
11.1 General Release
Web Growth Hub shall not be liable or responsible for any failure or delay in performance caused by events or circumstances beyond its reasonable control, including but not limited to:
Acts of God, natural disasters, floods, fires, earthquakes, or storms;
War, terrorism, riots, or acts of civil unrest;
Labor disputes, strikes, or shortages of labor or materials;
Failures of telecommunications, internet service providers, or third-party hosting services;
Government actions, embargoes, sanctions, or regulatory requirements;
Power outages, cyberattacks, denial-of-service attacks, or other malicious acts by third parties.
11.2 Continuation of Obligations
Where feasible, Web Growth Hub will make commercially reasonable efforts to mitigate the impact of a Force Majeure Event and to resume performance as soon as reasonably practicable.
11.3 No Breach
Any delay or failure in performance resulting from a Force Majeure Event shall not constitute a breach of these Terms.
12. Dispute Resolution and Governing Law
12.1 Governing Law
These Terms shall be governed exclusively by the laws of the State of Connecticut, without regard to conflict of law provisions.
12.2 Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms, the Platform, or the Services shall be resolved by binding arbitration in Connecticut under the rules of the American Arbitration Association (AAA).
Arbitration shall be conducted before a single arbitrator selected in accordance with AAA procedures.
The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of these Terms.
Judgment upon the arbitration award may be entered in any court of competent jurisdiction.
12.3 Waiver of Class Actions
You acknowledge and agree that any arbitration or proceeding shall be conducted only on an individual basis and not in a class, consolidated, or representative action. You expressly waive your right to participate in a class action or class-wide arbitration.
12.4 Limitation on Claims
Any claim you may have against Web Growth Hub must be filed within one (1) year of the event giving rise to the claim, or such claim shall be barred permanently.
13. Miscellaneous
13.1 Entire Agreement
These Terms, together with the Privacy Policy and any supplemental agreements or addendums, constitute the entire agreement between you and Web Growth Hub regarding your use of the Platform.
13.2 No Exclusivity
You acknowledge and agree that Web Growth Hub may provide Services to competitors, and nothing in these Terms grants you exclusivity.
13.3 Severability
If any provision of these Terms is found unenforceable or invalid, the remaining provisions shall remain in full force and effect.
13.4 Assignment
You may not assign or transfer your rights under these Terms without prior written consent from Web Growth Hub. Web Growth Hub may assign these Terms in connection with a merger, acquisition, or sale of assets without restriction.
13.5 Notices
Notices shall be deemed properly given when:
Sent by email to [email protected];
Posted publicly on Web Growth Hub’s website; or
Sent by certified mail to the business address listed in Section 1.
13.6 Waiver
Failure by Web Growth Hub to enforce any provision shall not constitute a waiver of its right to enforce that provision at a later time.
13.7 Headings
Headings are for convenience only and shall not affect interpretation.
Exhibit A – Code of Conduct
Users of the Platform agree to abide by the following Code of Conduct:
Professional Use: The Platform shall be used solely for legitimate business purposes.
Respect for Others: Users may not engage in harassment, threats, or abusive conduct through the Platform.
No Misrepresentation: Users may not impersonate others or misrepresent their business affiliations.
No Malicious Activity: Users shall not upload viruses, malware, or harmful code to the Platform.
Transparency in Communications: All communications sent through the Platform must be truthful and not deceptive or misleading.
Compliance with Laws: Users agree to comply with all federal, state, and international laws, including those governing advertising, data privacy, and telecommunication.
Accountability: Users are responsible for the actions of their employees, contractors, or agents who access the Platform under their account.
Violation of this Code may result in suspension or termination of access.
Exhibit B – AI Acceptable Use
While Web Growth Hub reserves the right to issue a more detailed AI policy in the future, the following rules apply at this time:
No Sensitive Reliance: AI Services may not be used to provide medical, legal, financial, or professional advice without human oversight.
No Misuse: AI Services may not be used to generate unlawful, harmful, or discriminatory outputs.
Review Required: Users must review and approve AI outputs prior to reliance or use in business operations.
Responsibility: Users remain solely responsible for all outcomes resulting from AI-generated communications or outputs.
Exhibit C – Communications Compliance
The following apply to all communications made through the Platform:
Consent: You must obtain prior express consent before sending SMS, email, or voice communications to recipients.
Opt-Out Mechanisms: All communications must provide a clear and functional opt-out mechanism.
Do Not Call: You must honor all state and federal Do Not Call registry requirements.
Message Content: Messages may not contain false, deceptive, or misleading claims.
Identification: All messages must clearly identify your business and include contact information.
Indemnification: You indemnify Web Growth Hub for any regulatory penalties, fines, or claims resulting from your non-compliance.
Definitions
For purposes of these Terms, the following definitions shall apply:
“Account” means the subscription profile created by you or on your behalf to access the Platform.
“Add-On Services” means optional features beyond standard subscription tiers, including Voice AI, listings deployment, or additional users.
“AI Services” means artificial intelligence-driven features of the Platform.
“Agreement” means these Terms of Service and any referenced policies.
“Applicable Law” means all federal, state, local, and international laws and regulations governing your use of the Services.
“Billing Cycle” means the recurring monthly or annual period in which subscription fees are charged.
“Cancellation” means the termination of your subscription by you in accordance with Section 3.6.
“Content” means any data, text, images, audio, or video uploaded by you or your users.
“Customer” means your clients, prospects, or leads interacting with communications or websites deployed through the Platform.
“Data” means all information entered, uploaded, or transmitted through the Platform.
“Fees” means subscription charges, add-on charges, and all applicable taxes.
“Force Majeure Event” means circumstances beyond Web Growth Hub’s reasonable control as defined in Section 11.
“Indemnified Parties” means Web Growth Hub and its affiliates, officers, employees, contractors, and agents.
“Intellectual Property” means all copyrights, patents, trademarks, trade secrets, and proprietary technology of Web Growth Hub.
“Liability Cap” means the limitation of liability outlined in Section 8.
“Manage Billing” means the online portal within the Platform where subscription management occurs.
“Platform” means the Web Growth Hub software, applications, and services as defined in Section 2.
“Services” means the full suite of CRM, automation, AI, hosting, and related tools provided by Web Growth Hub.
“Subscription” means the ongoing license to use the Services in exchange for recurring payment of Fees.
“User” means any person authorized by you to access the Platform under your account.
“You” or “Your” means the individual or entity entering into these Terms.
